Apply for D7 Visa from UK as a US citizen

Hello all.

I am a US citizen currently living and working in the UK. I am looking at retiring in Portugal towards the end of 2023 and was wondering if it was possible to apply for the visa from the UK. S suspect that I may have to go back to the US and apply from there since I need the FBI background check.

Thank you in advance fore any advice that you may provide.

Hi Robert and welcome to the forums! What is your visa status in the UK to live and work there as a US citizen? That may impact having to return to the US.

My apologies for the late reply. I am in the UK on a Tier 2 work visa, been here for two and a half years. I do not intend applying for ILR status as I would like to retire to Portugal at the end of this year.

As you've been living in the UK for more than a year you should be able to do it all from the UK.

Article 10.2 of Decreto Regulamentar 84/2007 specifies;

Salvo razões atendíveis, o pedido deve ser apresentado pelo requerente no país da sua residência habitual ou no país da área da jurisdição consular do Estado da sua residência.

And Article 12.1(c) would suggest that a UK CRO extract rather than an FBI check would meet the relevant background check criteria.

Certificado do registo criminal emitido pela autoridade competente do país de nacionalidade do requerente ou do país em que este resida há mais de um ano, quando sejam requeridos vistos de estada temporária e de residência;
