Is it time to reconsider GV?

We live in California, USA. We submitted a GV (by investment) application to SEF on June 2022. For various personal reasons we sold our house in the US and bought a place in Portugal in October 2022 and we are now renting an apartment in California and have all our stuff in storage till we have a visa. Unfortunately we are hearing of more and more delays to getting a residence visa. We can't really wait much longer so we are considering going the D7 visa route now.

Realistically, does anyone have any thoughts on when we could actually move to Portugal if we did continue with the GV (we have heard even two years mentioned!)? If it is very long we just may have to start the process again hoping for a faster result with a D7.

Thanks for any advice, thoughts or comments!

The D7 route might be a good idea, as desperate as it sounds, though it will likely take at least 4 months to get to visa approval via that route.  With another application in the works concurrently, though ... I think I would run it past a lawyer.  If you don't already have one for the Golden Visa process, you might try EDGE or Prime Legal in Lisbon.

@donn thanks! I agree, it may be time to forget the GV route. 4 months sounds good compared to some estimates of a year or more for the GV. I do have some excellent lawyers but of course they keep pushing the GV!! I will decide this week

Hi Marlon and welcome to the forums! You and in a precarious position. I see that GV applicants are suing SEF. SEF changes on April 1 and no clue what if any changes will occur.

You have a US passport? That gives you 90/180 days in Portugal. Do you have any correspondence from SEF on you GV application?

@jonesdn2020 thanks for your note! It’s the lack of clarity that is most concerning! No response at all from SEF and my lawyers keep saying it will happen but no real dates. From what I have read it could be up to a year! I just may have to forget the GV and do s D7!

@marlon Make sure you have planned out you tax situation if going the D7 route. The GV allows you to refrain from being a Portugal tax resident. The D7 process makes you become a tax resident and of course there is the NHR to help to a degree.

It also depends on why you were interested in the GV rather than a D7 in the first place.  If you were/are interested in the GV because you do not want to spend the minimum amount of time in PT required under a D7>>residency arrangement, the D7 will not get you what you want. If you will be happy and willing to spend the amount of time in PT as required under the D7, however, then why not take that shorter route and remove the uncertainty of the wait.
