[Sticky] NHR UPDATE

We have an update to share from our visa partners and experts Ei! Assessoria Migratória:

The transitory regime has now been approved.

You can still apply for NHR if you had all or any of the following in place by 10th October 2023:

  1. Rental contract or equivelent.
  2. Promissory agreement to purchase or reserve a property.Registration of children in educational establishment.

You can also still apply if you have all or any of the following in place by 31st December 2023:

  1. Employment contract or promissory employment contract or displacement agreement (only for work performed in Portugal).
  2. Residency visa or residency permit.
  3. Initiated the process for a residency visa or residency permit with the competent authority by appointment or request of it with VFS, Consulate or Embassy as appropriate.

All of the above conditions are applicable to the household of the applicant. If you can meet any of the conditions within the deadlines, you have up to 31st December 2024 to apply for NHR.

Is there an official document that can be sited at the AT office.

As of this past Monday, When I last tried to change my address to Braga, Portugal;The AT clerk stated that they would not change the address until I show a residency card.

A Portugal address is required for the NHR application.

Regarding the last of these possibilities, the key words to be interpreted here are “initiated” and “appropriate authorities”. What does the government actually mean?

Here are the possibilities:

“Initiated” could mean just having the VFS appointment by Dec 31 — or as an attorney suggested to me, one could technically just SET the appointment by Dec 31, but not actually HAVE the appointment until 2024, and still be eligible for applying for VHR in 2024 (provided they are living IN Portugal in 2024 of course when they do apply).

How this is interpreted is critical to me: I was absolutely unable to obtain a VFS appointment online by Dec 31, so I am going as a walk-in on Dec 27. I have email proof from VFS that I have set that appointment (and had to beg for it). I just hope that email suffices as the definition of “initiated.”

And even if you have the VFS appointment by Dec 31, do you still have to bring a lease dated prior Oct 10?

Also, is VFS Global the “appropriate authority”? Or is it the Embassy.

So we could still be in muddy waters?

We are still in muddy waters until someone goes through the process and is told “YES” or “NO” and given the fractured nature of Portugal bureaucracy it still may remain different for everyone.

VFS is only a vendor and has no authority. AIMA in Portugal is the authority. The consulate only issues the visa upon AIMA’s approval. For the finer details, you should consider contacting one of the vetted professionals in the Business Directory. I can vouch for Ei! personally as an excellent source of timely, correct information. I wouldn’t leave it to a discussion forum if it means a significant tax risk for you.

Feliz Natal: as of this writing I know of no one who has been able to change there address and applied for the NHR without a residency card. If someone does know of a case, please make it known.

Hi, I do know of a person who used the receipt they received at their SEF appointment. Finanças accepted it. They wanted to get rid of their fiscal representative to avoid being charged again hence the rush to become tax residents of Portugal. This happened before the PM announcement though.

Yes, we did it. My partner and I went to the main Finanças office for our town’s county (Alcobaça), to be there when the door opened, no appointment. We had our SEF appt. receipts, our Attestados from the Junta de Fregueisa in our town (that took a couple days to receive), our original NIF certificates, passports. We made our request to change our address and release our assigned fiscal representatives and become tax residents. It was granted and all done at that meeting. We went home with our new NIF documents, went online to our AT/Finançes portal (we had our passwords previously) to register ourselves in the NHR with that new updated certificate. NHR was granted a day later on the portal. This was all done in November.
